WAIRE 101
The Indirect Source Reality
SCAQMD Rule 2305 — the Warehouse Indirect Source Rule — holds your building accountable for the truck traffic it attracts. Understanding the mechanics is the first step to controlling your costs.
What Is It?
SCAQMD Rule 2305, the Warehouse Indirect Source Rule, targets large warehouse facilities across the South Coast Air Basin as indirect sources of diesel emissions.
The Logic
Regulators hold the building itself responsible — not the trucking companies — because the warehouse attracts the polluting vehicle traffic that affects surrounding communities.
The Metric: WPCO
Your Points Compliance Obligation (WPCO) is calculated from WATTs — Weighted Annual Truck Trips. More trips mean a higher obligation and greater exposure to fees.
The Penalty
Fall short of your required points and you pay a Mitigation Fee of $1,000 per point — a direct cash payment to the state with zero return on investment.
2026 Compliance Landscape
Who Is Affected?
The 100,000 Sq. Ft. Threshold
WAIRE applies to every warehouse operator in the South Coast Air Basin — covering Los Angeles, Orange, San Bernardino, and Riverside Counties — with facilities at or above 100,000 square feet. This also includes tenant operators utilizing at least 50,000 square feet within a 100,000+ square foot building. If you operate at this scale, you are already subject to the rule.
Full Stringency Is Now Active
All three phases (Phase 1, 2, and 3) are fully active at the strictest 1.0 Stringency level. There is no more phased leniency. The compliance bar has been set, and it isn't moving down.
The Landlord vs. Tenant Split
WAIRE draws a sharp line between owners and operators. Building owners must issue a Warehouse Owner Notification (WON); operators must file the Annual WAIRE Report (AWR) and demonstrate compliance.
This split creates legal and financial risk on both sides of a lease. SoCal WAIRE Solutions bridges the gap — protecting the asset owner while ensuring the operator meets their obligations without conflict or confusion.
Critical Deadlines
The Compliance Timeline
WAIRE is a calendar-year program — and the clock runs whether you're tracking it or not. The operators who win are the ones who plan in Q1, not Q4.
1
January 1
The compliance year begins. Points start accruing from day one based on truck activity at your facility.
2
Q1 / Q2
URS Projection Window. The optimal time to assess your WPCO, install infrastructure, and lock in compliance points before deadlines close in.
3
Q3 / Q4
Hardware lead times make late-year installation nearly impossible. Waiting until Q4 to plan is waiting too long — period.
4
December 31
The compliance year closes. All points must be earned within this window. No retroactive credits are available after year-end.
5
January 31
The Annual WAIRE Report (AWR) is due — or the next business day. Miss this deadline and enforcement mechanisms activate immediately.

The Q4 Trap: Waiting until Q4 to plan compliance means hardware cannot be installed in time. SoCal WAIRE Solutions focuses on Q1/Q2 projection so you can act before it's too late.
Enforcement
The Stick Is Real — and It's Getting Bigger
1,400+
Flagged Facilities
Facilities currently under NOV status for non-reporting or non-payment of mitigation fees.
$11,710
Per-Day Penalty
Maximum civil penalty per day of non-compliance — assessed on top of unpaid mitigation fees.
$1,000
Per-Point Fee
The mitigation fee charged for every compliance point you fail to earn through qualifying actions.
Notices of Violation (NOVs)
Over 1,400 facilities across the South Coast Basin have already been flagged for non-reporting or non-payment. SCAQMD is actively expanding enforcement — if you haven't filed, you are likely already on their radar.
On-Site Audit Risk
SCAQMD is now conducting on-site inspections. Manual truck logs are being rejected. Without a certified System of Record — like SoCal WAIRE Solutions' continuous monitoring — your data may not hold up under scrutiny, leaving you fully exposed to daily penalty accumulation.
NOV Recovery
Your Emergency Exit from an Active NOV
Receiving a Notice of Violation doesn't mean the situation is lost — it means the clock is running. SoCal WAIRE Solutions has a structured recovery process that stops daily penalties, negotiates settlements, and finds credits you didn't know you had.
1
Forensic Audit
SoCal WAIRE Solutions reconstructs your missing or incomplete truck trip data using AI-assisted analysis and third-party verification. The goal is to stop the daily penalty clock as quickly as possible by establishing a defensible compliance record from existing evidence.
2
Corrective Action Plan (CAP)
We prepare and submit a formal Corrective Action Plan to SCAQMD — a documented roadmap showing your commitment to infrastructure investment. A credible CAP demonstrates good faith and is often the key to negotiating significantly lower penalty settlements.
3
Retroactive Credit Recovery
Most facilities have already earned compliance points they never properly documented. SoCal WAIRE Solutions performs a thorough retroactive audit to identify and claim unreported credits — directly offsetting your outstanding fine and reducing the total amount owed to the state.
The WAIRE Menu
Strategic Mitigation Options — You Choose the Investment
The WAIRE Menu (Rule 2305) provides a flexible point-based system. Instead of paying a mandatory "tax," you choose the investments that best suit your facility's operations.
Zero-Emission (ZE) & Near-Zero (NZE) Vehicles
  • Acquisition: Earn points for purchasing, leasing, or renting ZE/NZE yard trucks or Class 8 tractors.
  • Usage: Points awarded for every visit by a third-party ZE/NZE truck to your facility.
  • Yard Operations: Significant point yields for daily operation of electric yard hostlers.
Charging & Fueling Infrastructure
  • EVSE Installation: Points for acquisition and construction of Level 2 or DC Fast Chargers.
  • Energy Dispensed: Earn ongoing "Usage Points" for every 165,000 kWh dispensed to ZE vehicles.
  • Hydrogen Fueling: Points for onsite hydrogen station installation and throughput.
Onsite Energy Generation & Storage
  • Solar PV: Points for the kW capacity of new rooftop or carport solar systems.
  • Battery Storage: Earn points for installing energy storage to manage peak loads and support EV charging.
Community & Health Upgrades
  • Air Filtration: Earn points for installing or upgrading to MERV 16+ filters in community buildings (schools, hospitals, etc.) near your facility.

Custom WAIRE Plans: Beyond the Menu — If your facility has unique operational constraints or innovative technology, you can submit a Custom WAIRE Plan for SCAQMD approval. Custom measures allow you to earn points for specialized efficiency projects, including Power Conditioning and Energy Management Systems that optimize grid interaction and reduce facility-wide emissions.
The SoCal WAIRE Solutions Advantage: SoCal WAIRE Solutions helps you navigate this menu to select the highest-ROI actions. We handle the "Usage Tracking" required to prove your points, ensuring you get maximum credit for the energy your facility consumes.
ROI Strategy
Turning Mitigation Fees into Profit
Every dollar paid to the state in mitigation fees delivers zero return. The same dollar invested in Solar and EV infrastructure earns compliance points, reduces operating costs, and builds permanent asset value. This is the "Avoided Cost" model — and it changes everything.
Pay the State
$100,000 mitigation fee = 100% loss. No asset, no return, no recourse. The check is gone and your obligation resets next year.
Invest with Our Network of Trusted Partners
$100,000 in Solar/EV infrastructure earns compliance points, lowers utility bills, enables zero-cost EV fueling, and increases your building's market value.
Reduced Fee Liability
Qualifying infrastructure investments generate compliance points that directly eliminate your mitigation fee obligation — dollar for dollar, point for point.
Operational Savings
Solar generation cuts your utility bills. EV charging infrastructure provides zero-cost fueling for your fleet, reducing recurring OpEx year over year.
Asset Appreciation
Energy infrastructure is a permanent upgrade. Your building's value increases, and the "WAIRE tax" becomes equity — a strategic advantage in today's industrial real estate market.
